A married spouse receives a fixed preferential share, currently $350,000, and the rest is divided with the children by a set ratio. A common-law partner inherits nothing automatically, regardless of how long you were together, and must apply to court as a dependant. Money left to a child is generally held by the court until they turn eighteen, then released in one lump sum. Nobody is named to raise your children, and no one can act for you at all if you lose capacity while still living, because a will only speaks after death.
A will and two powers of attorney replace that formula with your own instructions: who administers your estate, who raises your children, who manages your money if you cannot, and who makes medical decisions if you are unable to speak for yourself.
