Accident Benefits (SABS)

After a motor vehicle accident in Ontario, statutory accident benefits are claimed through your own insurer under the SABS. The forms are dense, the deadlines are short, and denials are common. We manage the process and push back when benefits are wrongly refused.

Scope of ServiceLicensed paralegals are authorized by the Law Society of Ontario to provide legal services, including legal advice and representation, in these practice areas.

How we help

  • OCF forms completed correctly and on time
  • Medical and rehabilitation benefit claims and treatment plan disputes
  • Income replacement and non-earner benefit claims
  • Insurer examination (IE) preparation and response
  • Disputes before the Licence Appeal Tribunal

Deadlines matter

Notice and application timelines under the SABS begin running at the accident. If you have been in a collision, contact us early, even if you are unsure whether you will claim.

Common scenarios & your rights

Scenario

Another driver hits you from behind. Your neck stiffens overnight, you miss work, and the insurance calls begin.

Your Rights

  • Accident benefits come from your own insurer, regardless of who was at fault.
  • Notify your insurer within 7 days, or as soon as practicable, and return the application within 30 days of receiving the forms.
  • Benefits can include medical and rehabilitation costs and income replacement.
  • A denial is not the end. Disputes go to the Licence Appeal Tribunal, generally within 2 years of the denial.

What to do: See a doctor early, report the collision, keep every receipt, and have the OCF forms reviewed before you submit them. Small wording choices shape the whole claim.
