Small Claims Court

Small Claims Court decides civil disputes up to $35,000. The procedure is simplified, the strategy is not. We act for plaintiffs and defendants from the first demand letter through trial and enforcement.

Scope of ServiceLicensed paralegals are authorized by the Law Society of Ontario to provide legal services, including legal advice and representation, in these practice areas.

How we help

  • Demand letters and pre-litigation strategy
  • Plaintiff's claims and defences drafted and filed
  • Settlement conferences and negotiation
  • Trial representation and witness preparation
  • Judgment enforcement, including garnishment and examinations

Honest case assessment

Not every claim is worth suing on. Before you spend a dollar on filing fees, we assess liability, damages, and collectability, and tell you plainly whether the case justifies the cost.

Common scenarios & your rights

Scenario

You finished a renovation contract worth $18,500 four months ago. The client praises the work in texts but never pays.

Your Rights

  • You may sue in Small Claims Court for up to $35,000, plus interest and costs.
  • The basic limitation period is generally 2 years from when you discovered the claim.
  • A well-drafted demand letter resolves many disputes without a filing fee.
  • Winning engages enforcement tools: garnishment, writs, and debtor examinations.

What to do: Preserve the contract, texts, photos, and invoices now. Send a firm demand letter with a deadline, then file before memories and assets fade.

Scenario

A courier hands you a Plaintiff's Claim alleging you owe a former business partner $22,000. You believe the number is exaggerated.

Your Rights

  • You generally have 20 days after service to file a Defence.
  • Ignoring the claim risks default judgment for the full amount.
  • You may dispute the debt, plead your version of events, and bring a counterclaim in the same proceeding.

What to do: Calendar the deadline immediately, gather your records, and have the claim assessed well before the 20 days run out.
